She can accuse you of anything, still she needs to produce some evidence. And since you and she allowed strangers on the room that make her case even weaker.
From now on just keep you mouth SHUT, and only claim “I’m inocent but since I don’t want to be framed I will use my constitutional right to remain silent and consult with a lawyer”.
Every-time you open your mouth you are providing evidence against yourself. So keep your mouth shut.
Your roommate is just “fishing”, since she doesn’t know for sure who stole her stuff. You can even acuse and sue her for defamation if she keeps acusing you without any evidence.
I there is no evidence I seriously doubt the Police or D.A will be willing to waste his time over a baseless claim.
If the police are involved, it’s a criminal investigation and will go to court. Get yourself some legal representation – the only thing I know you have to sign involving your Miranda rights is a waiver, and if you signed it without realizing that you were waiving your Miranda rights, then the entire case can be called in your favor on this technicality. Please, go find a lawyer before it’s too late.
u will probably have to go to court with the girl who accused u of stealing. good luck!
If you want to know if the detective is going to send his case to the DA, ask the detective. If you want to know if the DA is going to file the charge, ask the DA. There is no universal answer. It will depend on the whole of the evidence, not just your part. It will also depend on work loads, the laws of your state and a million other factors. As you are adult, it is not the business of your parents any more than it would be if you were 50. Of course, the school might take action independently of the cops, but that was not your question.
BTW, the prison is full of people who had no reason to commit the crime.
